DROPON PRIVACY POLICY

This Privacy Policy (“Policy”) describes the policies and procedures on the collection, use, disclosure and protection of your “Digital Personal Data and Personal Data” (collectively “Data”) when you use our website or mobile application for Customer or Rider (collectively, “Dropon Apps” or “Apps”) and is applicable, without limitation, to those including customers/service recipients and riders.

This privacy policy is an electronic record between you and Dropon as contemplated under the Information Technology Act, 2000, together with the rules framed under from time to time. The information about data protection listed below applies from 07/11/2024 and reflects the extended requirements for transparency set out in the Digital Personal Data Protection Act, 2023 (also referred in this Policy as “the said Act”).

By using the Dropon Apps and the Services, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your information as described and collected by us in accordance with this Policy. If you do not agree with the Policy, please do not use or access the Dropon Apps.

Dropon may change this Policy from time to time and accordance with the amendments made in the law by updating this page. This is the current and latest Policy effective from 07/11/2024. You should keep yourself updated by checking this page time and again. If you continue to access the Dropon Apps, it shall be construed as your deemed acceptance of the Policy.

The terms “You” and “Your” refer to the user of the Dropon Apps. The term “Services” refers to any services offered by Dropon, whether on the Dropon Apps or otherwise. This Policy is a part of and incorporated within, and is to be read along with, the applicable Terms of Use/Service.

  1. WHO IS THE DATA FIDUCIARY?
  1. Myzek Logistics Private Limited” (also referred to in this Policy as the “Company”, “Dropon”, “We”, “Us”, “Data Fiduciary”, “Data processor”) is the Data Fiduciary and we would like to inform you how we process your personal data in connection with our services and offers.

  • In accordance with the said Act, 2023, in order to provide readily means of grievance redressal, the Data Fiduciary has appointed a Data Protection Officer, the contact details of whom are provided below.   • TO WHOM IS THIS POLICY APPLICABLE?
  • This Privacy Policy is applicable to Dropon, and to all the users of our Dropon Apps. This Privacy Policy is specifically applicable to:
  • Customers: persons who access or use the Dropon Apps, create accounts, book the Services available, make payments through the Apps and post reviews or comments.
  • Riders: persons who use provide their logistical services to Dropon and thereby get listed on Dropon Apps as Riders by creating an account with Dropon.
  • Any access or use of the Dropon Apps by you and/or your representatives shall be deemed to be an express an unconditional acceptance by you of this Policy, and this Policy shall be legally binding on you.
  • This Policy does not apply to any website(s), mobile sites and mobile applications of third parties, even if their websites/products are linked to our Apps. You should take note that information and privacy practices of our business partners, advertisers, sponsors or other sites to which Dropon provides hyperlink(s), may be materially different from this Policy. Accordingly, it is recommended that you review the privacy statements and policies of any such third parties with whom you interact.
  • WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?
  • We process your data in accordance with the provisions of the Digital Personal Data Protection Act, 2023 and the rules made thereunder, if any. We process your data under Section 4(1) of the said Act and to fulfil our obligations under the said Act.
  • WHAT INFORMATION DO WE COLLECT?
  • Information you give to us: We ask for and collect the following personal information about you when you use our Apps. This personal information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.
  • Customer Account Registration: We collect the personal information provided by a Customer to us, upon creating or updating an account on our Apps to avail our Services. This includes, full name, date of birth, mobile number, email address, display picture, billing address, and company details such as company name, GST number and company address.
  • Rider Account Registration: When a Rider creates an account on our Apps to list their services, we collect GPS location, profile picture, copies of government identification documents and other details, call and SMS details which may be shared with our Customers while providing services. We collect background check and identify verification information of the Rider. This may include information such as Rider history or criminal record. In case you Sign up as a Rider, it enables feature that require Dropon’s access to other application on your device aiming to prevent frauds towards the Customers. In case if the Rider wishes to participate in the referral program, the contact list stored in the Rider’s phone will be accessed by us after taking the Rider’s consent to share such contacts. The Company will not share such contacts with any third party.
  • Verification Information:  We may collect your identity verification information (such as images of government issued ID, passport, national ID card, or driving license, as permitted by applicable laws) or other authentication information, as and when the need arises to ensure such a level of identity authentication, with clear prior intimation.
  • Payment Information (Customers): To make a booking on our Dropon Apps, we shall require certain financial information from the Customers, such as bank account details and credit or debit card information to facilitate the payments and comply with any applicable laws/regulations/rules.
  • Payment Information (Rider): To sign up as a Rider on Dropon Apps, Rider will be required to share their banking details with us for settlement of payments. This information includes, Name of the Account Holder, Account Number, IFSC Code, Branch Name, Bank Name and GST Number, if applicable.
  • Information we automatically collect: When you use our Dropon Apps, we automatically collect information, subject to your acceptance, including information about the kinds of services you use and how you use them. This information helps us enhance our services and functionalities of the Dropon Apps, to serve you better.
  • Location Information:  When you use certain features of our Apps, we may collect information about your precise or approximate location as determined through data such as your IP address or your device’s GPS to offer you an improved user experience. Most mobile/laptop devices allow you to control or disable the use of location services for applications in the device’s settings menu. We may also collect this information even when you are not using the Apps if this connection is enabled through your settings or device permissions.
  • App Usage Information: We collect information about how you interact with our services. This includes information such as access dates and times, application/website(s) features or pages viewed, application/website(s) crashes and other system activity, type of browser, and third-party sites or services you were using before interacting with our services. In some cases, we collect this information through cookies, pixel tags and similar technologies that create and maintain unique identifiers.
  • Transaction Information:  We collect transaction details related to your use of our services, including the type of services you requested or provided, your purchase details, date and time the service was provided, amount charged, duration of usage, and payment method.
  • Device Information: We may collect information about the devices you use to access our services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.
  • Communications and Interaction Information: When you communicate with Dropon or Rider or Customer or other members using our Dropon Apps, we collect information about such communication. For example, you may contact the Rider or avail our customer care services through the Dropon Apps. To provide this service, we may receive some information regarding calls or text messages, including date, time, duration and content of such communications. You may otherwise choose to provide us information when you provide us with reviews and ratings of a Rider’s services, fill in a form, conduct a search, respond to surveys, post to community forums, participate in promotions, or use other features of any of the Dropon Apps.
  • Cookies: Dropon uses cookies to protect and improve the services provided through our Apps, increase the ease of access to users, show you relevant content, monitor and analyse the performance, operation, and effectiveness of the Apps, and to serve you tailored advertising.

A cookie is a small data file that is transferred to your device). For example, a cookie could allow us to recognize your browser, while another could store your preferences. Cookies also allow ease of access, by logging you in without having to type your login name each time (only your password is needed); we may also use such cookies to display any advertisement(s) to you while you are on the Apps or to send you offers aligning with your interests.

We also use other technologies with similar functionality to cookies, such as web beacons, pixels, mobile identifiers, and tracking URLs, to obtain Log Data. For example, our email messages may contain web beacons and tracking URLs to determine whether you have opened a certain message or accessed a certain link.

We use traffic log cookies to identify which pages are being used. This helps us analyze data about webpage traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the website and/or Dropon Apps.

  • Information from third parties: We may receive information about you from third parties, in the course of your interaction with our Apps. We may retain this information to provide our services to the Customers and Riders, comply with legal obligations, or in order to improve our services and overall user experience. This information includes:
  • Customer ratings, reviews, and feedbacks. This shall include any images or videos uploaded by the Customer in its reviews.
  • Information received through linked social media or email accounts (Google, Facebook, etc.), third-party payment service providers through which you make payments on our Apps, and APIs used by our Apps.
  • Information in the public domain received through publicly available sources.
  • WHY DO WE PROCESS YOUR DATA (PURPOSE OF PROCESSING)?
  • We require this information to understand your needs and provide you with a better service, and in particular for the following reasons:
  • Internal record keeping and provision of Services: We may use the data or information to improve our services. Also, we may use the data or information to:
    • Allow you to use Services on the Dropon Apps and to carry out our obligations from the contracts between you and us.
  • Allow you to undertake or initiate any transactions on the Dropon Apps.
  • To inform your usage of the Dropon Apps and to manage your account with Dropon Apps.
  • To process the payments with respect to the transactions which you may avail on the Dropon Apps and to perform ancillary services.
  • To determine booking fees, rider commission and other charges.
  • To send commission update messages to the Rider.
  • To provide customize the content of our Apps and present tailor-made suggestions to you.
  • To respond to your comments, reviews and questions, in order to provide customer support and better services.
  1. Recording and processing customer feedback and customer enquiries.
  • To send promotional messages, marketing, advertising and other information based on your preferences and usage of Apps and services. This includes social media advertising through various platforms such as Google, Facebook, Instagram, etc.
  • To communicate important notices and changes to the Services provided on the Dropon Apps.
  • To track the order status, processing, and delivery of Services as per your applicability.
  • Contact you on your birthday or a special occasion, to offer a special gift/discount.
  • For any other purposes with your consent.
  • We may periodically send promotional emails, SMS, and make voice calls about new products, special offers, general offers, additional services or other information which will be beneficial and betterment of Users/Customers and Riders.
  • From time to time, we may also use your data and information to contact you for market research purposes. We may contact you by email, SMS, voice, fax or mail. We may use the data or information to customize the Dropon Apps according to your interests.

(For the purposes of (i) and (j) above, you may specifically opt-out in accordance with the Telecom Commercial Communications Customer Reference Regulations, 2018 or otherwise specified. In case you wish to opt out of the same, please contact us at aalap@dropon.delivery

  • Disclosure: We may disclose to third party services certain personally identifiable information listed below:
  1. Information you provide us such as name, email, mobile phone number, language.
  • Information we collect as you access and use our Services, including device information, location and network carrier. We collect precise or approximate location data in foreground when the Dropon Apps from your mobile devices if they enable us to do so. Dropon collects this data from the time a ride or delivery is requested until it is finished, and any time the app running in the foreground of your mobile or other device. We use this data to enhance your use of our Dropon Apps, including to improve pick-up locations, enable safety features, and prevent and detect fraud. Dropon collects the Rider’s location data, and links location data collected during a trip with their Customer’s account, even if the Customer has not enabled us to collect location data from their device. This enables us to offer services to the Customers like receipt generation and customer support.

This information is shared with third party service providers under contracts entered into with them so that we can:

  1. Personalize the Dropon Apps for you so you get the smoothest experience.
  • Perform behavioral analytics.
  • Personalize, measure and improve our advertising.
  • Sharing of information with our vendors, consultants, marketing partners, research firms and other service providers or business partners such as payment processing entities, to support our Services.
  • We may share your information with our academic partners for the purposes of carrying out academic research.
  • In case you are a Rider with Dropon, we may share your name, phone number and/or profile picture (If applicable) with other users in order to provide them the Services.
  • We may disclose this information with the government agencies, enforcement agencies or other companies assisting us, when we are obliged under applicable laws or in good faith or in compliance to any orders or processes; or detecting and preventing against actual or potential occurrence of identity theft, fraud, abuse of services and other illegal acts.
  • Safety, Security and Support:
  1. To detect and prevent fraud, spam, abuse, and other harmful activity.
  • To verify or authenticate account information provided by a Customer or Rider.
  • Using ratings and reviews to improve performance of Riders, and to deactivate accounts that are below a required threshold of ratings.
  • To assist Customers and Riders when they contact the customer support services, by providing the customer support executive with the required details of the Customer or Rider, to verify their identity, information of the booked services and payment details, to ensure speedy redressal of issues.
  • To conduct checks against databases and other information sources, to the extent permitted by law.
  • Legal Requirements:
  1. To enforce the Terms of Use and Terms of Services, available on our Apps.
  • To comply with legal and regulatory obligations.
  • To communicate any changes in the Privacy Policy, Terms of Use, Terms of Service or any other agreement.
  • To resolve any disputes between the Customer and Riders, and enforce agreements, with or between them.
  • To investigate or address claims or disputes relating to your use of Dropon’s services.
  • WITH WHOM DO WE SHARE YOUR INFORMATION?
  • At the time of booking:
  • For Customers:

Your personal information such as name, email-address, contact number, and billing address will be shared with the Rider whose services have been booked by a Customer, to enable the Customer’s identity verification at the time of availing the services.

How the said Rider use the information shared with them is beyond the purview and control of Dropon as they process personal information as independent data fiduciaries, and hence we cannot be made accountable for the same.

  • For Riders:

The Rider’s information (other than the information that was already available for display on the Apps) such as contact person/manager, contact details, detailed address, etc. will be shared with the Customer when a booking is made.

  • Profiles and Listings:
  • Pages on the Dropon Apps are publicly visible and include information such as the services offered, description and details of the rider, or precise location (where you have provided your consent), your Electric Vehicle’s photographs and any additional information.
  • After completing a booking, Customers may write reviews and rate the Services. Reviews and ratings are a part of your public profile page and may also be surfaced elsewhere on the Dropon Apps.
  • Based on our legitimate interest to promote the Dropon Apps we may display parts of the Apps on sites operated by our marketing/business partners, using technologies such as widgets or APIs, wherein information from your profile page may also be displayed.
  • Information on the Dropon Apps may be indexed through third party search engines. In some cases, you may opt-out of this feature in your account settings. If you change your settings, these search engines may not update their databases. We do not control the practices of third-party search engines, and they may use caches containing your outdated information.
  • Legal Obligations and Compliances:

Dropon may share or disclose personal information and/or sensitive personal data or information:

  • if it is required to do so by law, required by any enforcement authority for investigation, by a court order, or in reference to any legal process, including where matters of public safety are involved or to respond to any judicial or quasi-judicial process and provide information to any statutory, legislative or governmental authorities.
  • to voluntarily release any information about Customers or Riders who we believe are engaged in illegal activities or are otherwise in violation of our Terms of Use or Terms of Service, without any court order or summons, if we believe, in our sole discretion, that such disclosure is necessary or appropriate to operate our Apps or to protect our rights and/or property.
  • for regulatory compliance, internal compliance, or audits.
  • to enforce and administer our Terms of Use, Terms of Service, the payment terms or other agreements with the Riders.
  • to protect the rights, property or personal safety of Dropon, its employees, its members, or members of the public,
  • in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.
  • Disclosures to Investors, Agents, Trustees and Acquirers:
  • We will disclose your information to prospective or existing investors and/or agents and/or trustees. Any such information disclosure requires the investors and/or agents and/or trustees to follow protection measures and not utilize the information in any way other than as provided under this Privacy Policy, Terms of Use or Terms of Service. Although the investors, agents and trustees are subjected to a strict code of confidentiality, Dropon cannot be held liable in the event any investor, agent or trustee discloses your information to any third party.
  • Dropon may transfer, sell or assign all or any part of your information to any person or company that may acquire Dropon, in part or whole, as a result of a merger, acquisition, re-organization, change in control, sale, consolidation, transfer of assets or liquidation.
  • Payment Services:
  • Dropon shall share information with Payment Gateway Service providers to ensure processing and settlement of payments. Dropon shall share your full name, email address, contact number, amount payable, bank account details, credit or debit card details, and other third party payment platforms or methods shall be shared with the Payment Gateway Service providers.
  • Other Disclosures and sharing:
  • Cloud storage providers.
  • Marketing partners and marketing platform providers.
  • Data analytics providers.
  • Research partners, including those performing surveys or research projects on behalf of Dropon.
  • Third parties, affiliated with Dropon or otherwise, that assist Dropon to enhance the safety and security of its Platforms.
  • Consultants, lawyers, accountants and other professional service providers.

(The information (including aggregate cookie and tracking information) we provide to such third parties are protected by confidentiality agreements and such information is to be used solely for completing the specific project, and in compliance with the applicable regulations.)

  • HOW DO WE PROTECT YOUR INFORMATION?
  • All payments on the Apps are secured. This means all information you provide is transmitted using TLS (Transport Layer Security) encryption. TSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us. Dropon Apps have stringent security measures in place to protect the loss, misuse, and alteration of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession we adhere to strict security guidelines, protecting it against unauthorized access.
  • Dropon uses the internet to collect and process your information, in accordance with the provisions described in this Privacy Policy. Since the internet is a globally accessible platform, your information undergoes transmission on an international level and cannot always be 100% insulated from unauthorized use and access. By accepting this Privacy Policy, you consent to our use of the internet to collect, store and transmit your information to and from our servers.
  • Further, any information that you may share on or through our Apps, such as images or other content posted on our Platforms or transmitted through our Apps, may be accessed by other Customers or any third parties with whom you may or may not be familiar. Therefore, due to the aforesaid reasons, we advise you to exercise strong caution in sharing your information. While we use commercially reasonable efforts to protect your information, we cannot be held responsible for the actions of other users and/or any third parties and/or for any dissemination of information that may result from you exchanging it with any other users and/or third parties.
  • In the event any or all of your information is disclosed to any user and/or unauthorized third party by any reason whatsoever, including without limitation, by reason of an error in transmission, or an act or omission committed by any person or for any other reason, Dropon cannot be held liable or responsible in any capacity/manner whatsoever.
  • You will be required to enter your password to access your account and will have the option to sign out once you have finished. Your password restricts unauthorized access to your information and helps guard your privacy once you have signed out. Dropon takes stringent measures to protect your privacy. However, in the event that your password fails to protect your information from hackers, unauthorized users or due to a system or software failure, Dropon cannot be held liable or responsible in any capacity/manner whatsoever.
  • WHAT PERMISSIONS ARE REQUIRED FOR USING OUR MOBILE APPLICATION?

When the Dropon Application is installed on your device, a list of permissions appears and are needed for the Apps to function effectively. The permissions that Dropon requires and the data that shall be accessed and its use is as below:

  • Android permissions:
  • Device & Application history: We need your device permission to get information about your device, like OS (operating system) name, OS version, mobile network, hardware model, unique device identifier, preferred language, etc. Based on these inputs, we intend to optimize your booking experience.
  • Identity: This permission enables us to know about details of your account(s) on your mobile device. We use this info to auto-fill your email ID’s and provide a typing free experience. It helps us map email ID’s to a particular user to give you the benefit of exclusive offers, wallet cash-backs, etc.
  • Location: This permission enables us to give you the benefit of location specific deals and provide you a personalized experience. When you launch the Dropon Application to make a booking, we auto-detect your location so that we can provide you with the nearest Rider for your needs. Your options are personalized basis your location.
  • SMS: If you allow us to access your SMS, we read your SMS to autofill or prepopulate ‘OTP’ while making a transaction and to validate your mobile number. This provides you a seamless purchase experience while making a booking and you don’t need to move out of the application to read the SMS and then enter it in the application.
  • Phone: The application requires access to make phone calls so that you can make phone calls to Riders and our customer care center directly through the application.
  • Contacts: If you allow us to access your contacts, it enables us to provide a lot of social features to you such as sharing your booking with your friends, inviting your friends to try our application, send across referral links to your friends, etc. This information will be stored on our servers and synced from your phone.
  • Wi-Fi connection information: When you allow us the permission to detect your Wi-Fi connection, we optimize your experience such as more detailing on maps, better image loading, etc.
  • Device ID & Call information: This permission is used to detect your Android ID through which we can uniquely identify users. It also lets us know your contact details using which we pre-populate specific fields to ensure a seamless booking experience.
  • IOS Permissions:
  • Notifications: If you opt in for notifications, it enables us to send across exclusive deals, promotional offers, trip/booking related updates, etc. on your device. If you do not opt for this, updates for your booking like status, booking confirmation, refund (in case of cancellation), etc. will be sent through SMS.
  • Contacts: If you allow us to access your contacts, it enables us to provide a lot of social features to you such as sharing your booking with your friends, inviting your friends to try our application, send across referral links to your friends, etc. This information will be stored on our servers and synced from your phone.
  • Location: This permission enables us to give you the benefit of location specific deals and provide you a personalized experience. When you launch the Dropon Application to make a booking, we auto-detect your location so that we can provide you with the nearest Rider for your needs. Your options are personalized basis your location.
  1. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?
  1. Dropon will retain your personal information on its servers for as long as is reasonably necessary for the purposes listed in this Privacy Policy. In some circumstances, we may retain your personal information for longer periods of time, for instance where we are required to do so in accordance with any legal, regulatory, tax or accounting requirements.
  1. Where your personal data is no longer required, we will ensure it is either securely deleted or stored in a way which means it will no longer be used by the Company.
  1. MANAGEMENT OF INFORMATION AND WITHDRAWAL OF CONSENT
  1. You may access and update some of your personal information through your account settings. If you have chosen to connect your account to a third-party application, like Facebook or Google or Instagram, you can change your settings and remove permission for the Application by changing your account settings. You are responsible for keeping your personal information up-to-date.
  1. You have the right to ask for a review of your personal information that you have provided, and to correct inaccurate or incomplete personal information concerning you (and which you cannot update yourself within the Apps).
  1. You have the statutory and absolute right to not provide your personal or sensitive personal information as required by us. You also have the right to withdraw your consent to submit any or all personal information or decline to provide any permissions on its Apps as covered above at any time. In case, you choose to do so then your access to the Apps may be limited, or we might not be able to provide the services to you. You may withdraw your consent by sending an email to aalap@dropon.delivery  We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety. We may retain and use your personal information to the extent necessary to comply with our legal obligations such as tax compliances, legal reporting and auditing obligations.
  1. WHAT ARE YOUR RIGHTS AS A DATA PRINCIPAL?
  1. Right to access information about personal data:
  1. The user/ rider agent will have the right to obtain data from the Data Fiduciary to whom consent has been previously given, upon making a request in writing to the Data Protection Officer. Upon receiving such request, the Data Fiduciary ought to provide:
  1. a summary of personal data which is being processed by such Data Fiduciary and the processing activities undertaken by that Data Fiduciary with respect to such personal data;
  • the identities of all other Data Fiduciaries and Data Processors with whom the personal data has been shared by such Data Fiduciary, along with a description of the personal data so shared; and
  • any other information related to the personal data of such Data Principal and its processing, as may be prescribed.
  1. Right to correction and erasure of the personal data:
  1. You shall have the right to correction, completion, updating and erasure of her personal data for the processing of which you have previously given consent.
  1. Dropon shall, upon receiving a request for correction, completion or updating from you:
  2. correct the inaccurate or misleading personal data;
  3. complete the incomplete personal data; and
  4. update the personal data.
  1. You shall make a request in writing to the Data Protection Officer, for erasure of your personal data, and upon receipt of such a request, Dropon shall erase your personal data unless retention of the same is necessary for the specified purpose or for compliance with any law for the time being in force.
  1. Right to grievance redressal.
  1. This right allows you to address your issues related to processing/erasure/fraud/data breach or other ancillary issues to the Data Protection Officer of Dropon.
  1. You shall have the right to have readily available means of grievance redressal provided by Dropon in respect of any act or omission of Dropon regarding the performance of its obligations in relation to your personal data or the exercise of your rights.
  1. Right to nominate.
  1. You shall have a right to nominate any other individual, who shall, in event of your death or incapacity, exercise your rights.
  1. WHAT ARE THE DUTIES OF THE CUSTOMERS/RIDERS?
  1. As per the provisions mentioned in the Digital Personal Data Protection Act, 2023, the following shall be your duties:
  1. To ensure not to impersonate another person while providing the data for specified purpose;
  1. To ensure not to suppress any material information while providing the data for any document, unique identifier, proof of identity or proof of address issued by the state or any of its instrumentalities;
  1. To ensure not to register false or frivolous grievance or complaint with Data Fiduciary or the Board;
  1. To furnish only such information as is verifiably authentic, while exercising the right to correction or erasure under the provisions of this Act or the rules made thereunder.
  1. Also, in addition to the above-mentioned statutory duties here are some additional rules and regulations which shall be complied by you. You shall not host, display, upload, modify, publish, transmit, store, update or share any information and data that:
  1. Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy including bodily privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
  1. Is harmful to children;
  1. Infringes any patent, trademark, copyright or other proprietary rights;
  1. Violates any law for the time being in force;
  1. Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
  1. Threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nation;
  1. Contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource.
  1. Is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
  1. In case of with non-compliance with the above-mentioned statutory duties as well as additional rules and regulations, policy or terms of service, we have the right to terminate your access or usage to the computer resource or the Dropon Apps immediately or remove non-compliant information/data or both, as the case may be. Moreover, Dropon may file a complaint to the Data Protection Board in event of breach of the statutory duties along with the breach of significant additional rules and regulations which can affect the sovereignty and integrity of India under the said Act.
  1. WHAT IS THE CHAT FUNCTION AND WHAT/WHY DATA IS PROCESSED?
  1. Chat Function:
  1. You can use Dropon chat assistant to contact us and communicate with us on our App.
  1. We recommend that you are cautious about disclosing data and only share information in the chat that is necessary for the service you would like to use.
  1. If you contact the chat assistant via web chat, a session-based anonymized User ID will be assigned to you. The content of your inputs and the answers from the chat assistant will be stored against this User ID.
  1. All the data you enter during the course of the web chat dialogue with the chat assistant is passed to a commissioned data processor and processed there for the purpose of handling your request. Your chat entries will be analyzed to help process your request and compared against the functions and information provided by us to our commissioned data processor. If it is not possible to handle your enquiry in this process step using a dialogue provided in the software, your input texts will be shared with another commissioned data processor who analyses them using special software and compares them to a knowledge database, whose content we have also provided. Entries that match your input text will be sent back to you.
  1. To maintain and continuously improve the quality of the customer services provided by our service center staff, we would like to evaluate samples of live chat session communications. To do this we need your consent, which we request before forwarding you to our live chat agents. You can withdraw your consent at any time during and after the live chat session. You can inform our agents that you want to withdraw your consent during the live chat session, or you can contact us for this purpose using our online form.
  1.  Feedback Function:
  1. You can also use the “Thumbs up” and “Thumbs down” function to send us your feedback about the information provided by the chat assistant. Your feedback will be stored as part of the flow of your web chat. If you wish to give us feedback about the chat assistant, you have to request this explicitly by text input. You then have option of entering your feedback in text form in the web chat.
  1. Push Notifications:
  1. If you contacted us via chat assistant and gave us consent there, we will also send you information about booking, for example when you book a Rider to deliver your shipment or to receive the shipment from any other user.
  1. When the Rider has successfully delivered the shipment, the Customer will get a push notification regarding the feedback of the services given by the Dropon through its Rider.
  1. You can withdraw your consent with future effect at any time. Please enter the word “Withdraw” in the dialogue window of the chat assistant.
  1.  Technical Troubleshooting and Quality Improvement:
  1. In the case of technical malfunctions, we have to analyze chat histories in detail on a case-by-case basis to be able to identify the causes of the technical malfunction and to take corrective action. We analyze all dialogues and your feedback in order to improve the quality of the chat assistant functionalities. To do so, all references to you are removed, so that only anonymized data is used for this purpose and your data cannot be analyzed or linked to you.
  1. WHAT IS THE GOVERNING LAW OF THIS POLICY?
  1. This Privacy Policy is in adherence to, and shall be governed by the laws of India, and any disputes, controversies or claims arising out of this Privacy Policy or any provisions stated herein, or between us and any Customer or Rider generally, shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat.
